Bud Light and 106.9 The Fox’s “Bud Light Party Cruise to Paradise Island” Promotion
Official Rules

  
Overview:

1) Beginning on or about May 5, 2008, Bud Light and WAFX 106.9 The Fox/Tidewater Communications, LLC, and its parent companies (referred to herein as 106.9 THE FOX/WAFX) will conduct the Bud Light Party Cruise Contest, giving 106.9 THE FOX/WAFX listeners a chance to win airfare from Norfolk International Airport OR Newport News Airport to and from Florida, as well as accommodations aboard the Bud Light Party Cruise Ship and all related activities aboard said ship from Bud Light 106.9 THE FOX/WAFX.  No purchase is required to enter or win.

Methodology/Qualifying Prizes:
 
2) 106.9 THE FOX/WAFX listeners may register in one of the following ways:
 
a) Attending any Bud Light Party Cruise and 106.9 THE FOX/WAFX registration on-site events. One finalist will be chosen from each event, not to exceed five events throughout the duration of the promotion.  Dates/locations of these events will be announced on 106.9 THE FOX/WAFX and posted on www.1069thefox.com.

b)  By being the 10th caller when an on-air DJ on 106.9 The Fox gives the cue-to-call during a daily feature. The caller must then answer a music related question correctly in order to become a finalist. Ten (10) finalists will be taken via on-air qualification between May 5th and June 13th, 2008.

c) By entering to win through the Fox Workforce. In order to enter, a registrant must either be a pre-existing Fox Workforce member, or sign up to join the Fox Workforce Email Club. Once an email address is registered within the Fox Workforce, a member may click the link provided on the Bud Light Party Cruise landing page to be registered as a qualifier. 

Finalist Selection

3) A maximum of twenty (20) finalists will be chosen from among all entrants.
Five (5) finalists will be chosen at random from all eligible entries on the Fox Workforce.
Five (5) finalists will be chosen at random from all entries at Fox on-site events where cruise entry is an option.
Ten (10) finalists will be chosen from on-air qualifiers during features. All qualifiers on-air are automatically finalists.

Winner Selection

4) One Grand Prize winner will be chosen from among all the finalists to win the Bud Light Party Cruise. The Grand Prize winner will be chosen at random during an on-site Launch Party on Saturday, January 14th. Finalists will all be notified by the Fox Promotion Department as to when and where they need to be present in order to claim their prize. The Fox Promotions Department will make every effort to contact all finalists at previously provided phone numbers and email addresses. If after two (2) consecutive tries to contact a finalist with information as to where the Launch Party will be held, Fox Promotions still cannot speak to that finalist, another finalist will be chosen. If a finalist is not present at the Launch Party, he or she will be disqualified from the opportunity to win the Grand Prize.
 

Grand Prize(s):
 
5) The Grand Prize is round-trip airfare from the Norfolk, Virginia area to the ship’s departing location, as well as accommodation aboard one of two Bud Light Cruise Ships for four (4) days and three (3) nights.  The total estimated retail value of prize is $4,600.  Trip taxes (including, but not limited to, sales taxes and income taxes), insurance and costs associated with the trip, including any travel and transportation costs associated with the trip, if applicable, are solely the responsibility of the winner.  If the winner fails to comply with the trip coordination, prize will be forfeited and an alternate winner will be selected. Any upgrades or options not part of the cruise as advertised are solely the responsibility and is at the sole expense of the winners. All expenses not expressly specified herein are solely the winner’s responsibility.  The difference between any stated value and the actual value will not be awarded to the winner.  The odds of winning depend upon the number of eligible entries received.  Award of the Grand Prize to the person selected is conditioned on the person selected meeting all the qualifications set out in these rules.  There is a limit one prize per household.

Legal/Restrictions:
 
6) All contestants must be 21 years of age (minimum age for legal consumption of alcoholic beverages) or older on the date of entering the contest, must be permanent residents of the state of Virginia and must have a valid form of identification.  In the event that a qualifier is under the age of 21 years, the qualifier will be excluded from the grand prize drawing. 

7)  All contestants must have a valid U.S. Passport or have the ability to obtain one prior to October 1, 2008. Any contestants without a passport or the proper documents and procedures to obtain one, will be ineligible to win.
 
8) All 106.9 THE FOX/WAFX General Contest Rules (attached) apply, and all decisions of 106.9 THE FOX/WAFX are final. 106.9 THE FOX/WAFX, Bud Light, all participating co-sponsor companies and their advertising and promotional agencies, affiliates thereof, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.  As a condition of entering a contest, participants may be required, upon winning, to sign a release form and affidavit of eligibility to claim their prize.  Failure to do so will result in forfeiture of the contestant’s right to claim or receive the prize

SAGA COMMUNICATIONS, INC. GENERAL CONTEST RULES

Wherever the words 106.9 THE FOX/WAFX appear in these rules, they include the business entity to which the station is licensed, and any member companies, parent corporations, and affiliates.  For example, Tidewater Communications, LLC would include Saga Communications of New Hampshire, LLC, its sole member, Saga Communications of New England, LLC, and its sole member, Saga Communications, Inc.  Columbus Radio Group would include Franklin Communications, Inc., its sole stockholder, Saga Broadcasting, LLC, and its sole member, Saga Communications, Inc.

1) No purchase is necessary to enter any 106.9 THE FOX/WAFX contest.
 
2) All contestants must be permanent residents of Virginia or Northeastern North Carolina within range of the WAFX air signal and must provide 106.9 THE FOX/WAFX with a valid form of identification and Social Security number satisfactory to 106.9 THE FOX/WAFX management.
 
3) Subject to rule (4) below, all contestants must be at least 18 years old to be eligible to participate in contests that include hotel/motel accommodations, motor vehicles, boats, and/or air travel as prizes.
 
4) All contestants must be at least 21 years old to be eligible for all contests affiliated with an alcoholic beverage manufacturer or distributor.
 
5) One entry per household will be permitted to participate in a contest.  A "household" is defined  as any individuals residing at the same address. All individuals/households receiving a prize valued at $500.00 or more on 106.9 THE FOX/WAFX may be issued a 1099 Federal Income Tax Form by 106.9 THE FOX/WAFX, and are ineligible to win a prize valued at $500.00 or more for a period of one calendar year from the date of winning. If it is determined that a selected contestant is ineligible as a result of one or both of these restrictions, another contestant will be selected.  This selection procedure will continue until these restrictions are satisfied.
 
6) Anytime the 106.9 THE FOX/WAFX on-air studio is called, it is assumed by the caller that the phone call is being recorded and may be broadcast.  The caller grants permission to 106.9 THE FOX/WAFX to broadcast the call or record the call for later broadcast.

6a) For telephone contests, listeners may enter by calling (757-523-1010).  If any problems are discovered by 106.9 THE FOX/WAFX, different call-in numbers or addresses may be substituted and utilized after those numbers and addresses are broadcast on 106.9 THE FOX/WAFX.  In the event a caller is disconnected during a contest before his/her name and phone number is recorded, then the prize will be awarded to the next caller whose name and phone number are recorded.  The person operating the telephone at 106.9 THE FOX/WAFX has the final decision as to who is the winning caller.
 
7) For contests requiring written entry forms, they may be faxed to (757-366-0022), e-mailed to a contest specific address on (www.1069thefox.com), or mailed/delivered to 106.9 THE FOX/WAFX – (870 Greenbrier Circle, Suite 399, Chesapeake, VA 23320).  All entries become property of 106.9 THE FOX/WAFX and will not be returned.  106.9 THE FOX/WAFX reserves the right to retain any or all contest materials for any reason that 106.9 THE FOX/WAFX deems necessary to the completion of the contest, or reasons relating to publicity and/or advertising.  106.9 THE FOX/WAFX shall have no responsibility for a contestant’s failure to win or claim any prize based on difficulties with telephone, facsimile, email, or internet difficulties, or any circumstances in any contest.
 
8) Any specific rules and/or restrictions pertaining to individual contests (entry dates, a limit on     number or words on an entry, etc.) will be disclosed in on-air announcements.
 
9) Prizes must be picked up by the winners at the 106.9 THE FOX/WAFX business office or other pre-arranged or pre-announced location within thirty (30) days of notification to the winner, unless there is a deadline date by which the prizes must be picked up, in which case, that date will be specifically stated.  Otherwise, failure to pick up the prizes by the deadline will result in the forfeiture of the prize, which shall remain the property of 106.9 THE FOX/WAFX.  106.9 THE FOX/WAFX assumes no liability for the delivery of prizes.
 
10) In the event the winner is subject to, or the subject of, any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), 106.9 THE FOX/WAFX's delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as 106.9 THE FOX/WAFX awarding the prize to the winner.  106.9 THE FOX/WAFX shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner.  106.9 THE FOX/WAFX shall not be liable for any claim by any winner for damages incidental thereto.
 
11) As a condition of entering a contest, contestants must agree that upon winning, they will consent to the use of their name, likeness, and all verbal and written communications with 106.9 THE FOX/WAFX for publicity purposes.
 
12)  Employees of 106.9 THE FOX/WAFX (Tidewater Communications, Inc.), (and its ultimate parent company, Saga Communications, Inc.), their advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one hundred mile radius of the main WAFX studio are not eligible to win any contest.  Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is current legal guardian.

13) All prizes are non-transferable and are not redeemable for cash. 106.9 THE FOX/WAFX reserves the right to substitute a prize of similar value.  106.9 THE FOX/WAFX cannot be held responsible for unforeseen cancellations or delays of concerts/events or transportation caused by weather, promoter or performer.
 
14) Winners are solely responsible for all applicable local, state and federal taxes.  Winner may be issued a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won in contests from 106.9 THE FOX/WAFX and/or participating co-sponsors exceeds $600.00.
 
15) 106.9 THE FOX/WAFX,(TIDEWATER COMMUNICATIONS, INC.), assumes no liability for liability, damages, situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. 106.9 THE FOX/WAFX, (TIDEWATER COMMUNICATIONS, INC.), all participating co-sponsor companies and their advertising and promotional agencies, affiliates thereof, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.  As a condition of entering a contest, participants may be required, upon winning, to sign a release form and affidavit of eligibility to claim their prize.  Failure to do so will result in forfeiture of the contestant’s right to claim or receive the prize.
 
16) The following are specifically related to E-contests and E-Mail Club promotions on (www.1069thefox.com):

a) All appropriate information in required fields must be filled out or contestants will be disqualified.
 
b) To be eligible to win a prize, a contestant must reside within the listening area of 106.9 THE FOX/WAFX, as defined within the exclusive discretion of 106.9 THE FOX/WAFX management.

c) Any problems with the internet or email are not 106.9 THE FOX/WAFX's responsibility.

d) Contestants who attempt to register to participate on 106.9 THE FOX/WAFX’s websites may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.
 
17) All giveaways and contests are void where prohibited by law.  All local, state and federal regulations apply. As a licensee of the FCC and a trustee of the public airwaves, 106.9 THE FOX/WAFX reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of 106.9 THE FOX/WAFX management if world events, the national mood, or public safety so warrant. 106.9 THE FOX/WAFX reserves the right to disqualify any winner if the contest rules have been violated in any way.  106.9 THE FOX/WAFX reserves the right to amend the rules to any contest at any time. All decisions of 106.9 THE FOX/WAFX are final.

18)  Although 106.9 THE FOX/WAFX will make reasonable efforts to conduct its contests substantially as announced or advertised, 106.9 THE FOX/WAFX reserves the right in extraordinary situations to change or modify the rules of its contests as exigent circumstances may require.  In such cases, 106.9 THE FOX/WAFX will amend the rules for that contest and broadcast the amended rules as promptly as possible.  In such case, the contest will be conducted in accordance with the amended rules.
